Techy LLC – Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the services provided by Techy (“we,” “us,” or “our”), including our website, in-store services, and any related communications. By using our services, you agree to be bound by these Terms.

1. Services Provided

We provide cellphone and electronic device repair services. We will diagnose the problem with your device and provide you with an estimate for the repair. We will only perform the repair if you approve the estimate.

2. Estimates and Payment

  • Estimates are provided based on our initial assessment of the device.
  • The actual cost may vary if additional issues are discovered during repair.
  • We will notify you of any changes to the estimate and obtain your approval before proceeding.
  • Approval can be provided in writing or verbally.
  • Payment is due upon completion of the repair.
  • A diagnostic fee may be charged if you decline the repair after diagnosis.

3. Data Loss

Important: You are solely responsible for backing up your data before bringing your device for repair. While we take precautions, we cannot guarantee that your data will not be lost or corrupted during the repair process.

4. Warranty

  • Our warranty covers defects in workmanship and parts used in the repair for the specified duration.
  • The warranty does not cover accidental damage, misuse, liquid damage, or unauthorized modifications.
  • The warranty is void if the device is opened or tampered with by anyone other than us.
  • To claim warranty service, you must return the device to us with proof of purchase.

5. Limitation of Liability

  • Our liability for any damages is limited to the amount you paid for the repair.
  • We are not liable for indirect, incidental, consequential, or punitive damages (including lost profits, data, or device use).
  • Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

6. Abandoned Devices

  • Devices not picked up within 30 days after notification may be considered abandoned.
  • We will attempt to contact you via phone and email before considering a device abandoned.
  • We may sell or dispose of abandoned devices to recoup our costs.

7. SMS/Text Messaging

We use SMS messaging through our point-of-sale (POS) system to communicate with you regarding:

  • Appointment reminders
  • Repair updates
  • Promotional offers (with your express consent)

Consent: By providing your mobile number and opting in, you consent to receive text messages from Techy Corporate. Consent may be provided verbally.

Opt-Out: Reply “STOP” to any message to opt out of all SMS campaigns.

Message Frequency: Frequency varies based on your repair status and appointments.

Charges: Message and data rates may apply. Check with your carrier for details.

10DLC Compliance: We comply with all applicable 10-Digit Long Code regulations.

  • Missed call notifications
  • Review requests

Privacy: We will not share your mobile number with third parties for marketing purposes.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law principles.

9. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved by relevant regulations in Florida.

10. Entire Agreement

These Terms constitute the entire agreement between you and us relating to our services and supersede all prior communications, whether oral or written.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Changes to These Terms

We may update these Terms periodically. Changes will be posted on our website with an updated “Last Updated Date.” Continued use of our services constitutes acceptance of the updated Terms.
